Trade Mark Registration is National and not state specific. A registered Trade Mark will give you the right to use the Trade Mark anywhere within Australia.

Business Name registration is different from Trade Mark registration and the concept around it is also different.

The idea behind Trade Mark registration is to note your interests in using the Trade Mark.

The idea behind Business Name registration is to provide information to the public that you or your company are trading under a different name.

I would consider that if you are trading under a different name from your trading entity, you must register your Business Name. If your Business Name is your Trade Mark, then I consider that you should register that Trade Mark.
