Google doesn’t require H tags to determine hierarchy, but if you use them, then use them in the right hierarchy.

If you install the Web Developer toolbar for Firefox and then do: Information > Document Outline, you will see any badly nested heading tags. The usual error is to mark the navigation links as H tags.

If there are no H tags then Google takes the cue from font size and emphasis. If you want all H tags to be the same size and font in CSS then go ahead, but don’t have an H3 without a preceding H2.
