In order to properly answer your question, more information from you would be required. At a minimum, it would be necessary to have regard to the types of goods being supplied / distributed by you, and to whom such supply is typically made. It would then be necessary to consider the potential basis of liability (e.g. contract, tort, statute) and the extent to which it would be permissable to limit that liability under our relatively new Australian Consumer Laws. I note, however, that you are not seeking merely to limit liability, but to have the benefit of an indemnity. On the indemnity point, have you considered the capacity to be indemnified by the actual manufacturer of the goods?
