Hi Writermich,

Certainly an interesting question and one I have been asked about previously..

Generally speaking, you cannot contract yourself out of negligence – although your terms and conditions can define what your relationship may be with the audience/ intended recipient, you cannot necessarily use T&C’s / disclaimers as an absolute defence. Furthermore, even if you do have T&C’s on your website, this will not stop claims occurring against you – the cost of defending these (which is usually covered by the insurance policy) may be greater than any compensation paid.

For some of your clients, it will be a requirement that you have Professional Indemnity insurance in place prior to a contract being formalised. You should certainly look at this type of cover (as well as other covers eg. Cyber Liability) as part of a complete risk management program.

Please let me know if you need me to clarify anything further.

Regards,

Mark
