    Hi there,

    I was wondering if a company name exists and the business name i want to set up already exists as a company name is that an issue? The company name is in a totally different industry to what i am planning to get in to.
    Also i am not starting a company, I am looking into starting a business

    Not an expert here…

    Although if the names are identical, regardless of industry, it is an issue.

    First step is to check IP Australia and see if the name is trademarked.

    If it is, then there’s no point going any further with it.

    Jason, I think OP is saying there’s a company name already registered, but the same name is not registered as a business name. The business name register is different so he may be okay.

    Hi Shaun,

    I’m definitely no expert either, but I would personally be doing my best to differentiate myself and building a brand!

    Even though the other business may be in a different industry, will people confuse the two of you? You don’t want potential clients calling the other business and then giving up because they can’t find you.

    Just a thought from a different perspective, but in terms of the legalities I have no idea.

    Thanks Mitchell, agree with you
    I looked into further with ASIC and if a company name exists, you cannot use it as a business name anyway as the company name overrides it anyway
