    Wondering if anyone can help here. I am importing a product from the USA where it is covered by patents and I would like to at least minimize copycats here in Australia for as long as possible so I asked my manufacturer to see if they could extend their patent into Australia. They are running into brick walls and can’t seem to find out what needs to be done, and the only info I get from IP Australia is that I can’t patent it here in Australia as it already exists in the USA and they need to do it over here. Not getting much help and can’t afford to pay for someone to do it just yet.

    Am new to importing and patents so not really sure where to start here.

    No replies but managed to find the following out which seems to be the answer.

    You can submit a PCT application to extend the range of your patent internationally. This is a Patent Co-operation Treatment.

    You can lodge this and pay for this via the Australian IP Australia website : http://www.ipaustralia.gov.au/get-the-right-ip/patents/patent-application-process/patents-overview-pct/

    OR

    You can do it via the World Intellectual Property Organization – WIPO
    http://www.wipo.int/pct/en/
