    Hey Everyone,

    I need someones assistance please. I am currently setting up my website for wedding/corporate floral designs in Sydney. I wanted to use the name Delflora (delicate flowers). I have just checked in ASIC and found there is a Delflora registered in VIC. I was told yesterday that you can have the same business name as long as you register by state…so I would be Delflora, NSW. Can I actually do this without Delflora VIC sueing my backside off?! They also dont have http://www.delflora.com.au either they use [url]http://delflora.net…..HELP[/url]! :D

    My understanding (From memory when I was setting up my business)…

    If a sole trader / partnership is registered in another state, the name is fair game in states it’s not registered.

    However, if a “company” is registered, it copyrights the name Australia wide.

    Also, another idea is to contact he ABR (link here), to check if the name is trademarked.

    Regardless of whether you ‘can’ use it or not, why would you? IMO it’s inviting trouble by using the name, assuming that you were allowed to register it. Why not look at another name that’s unique to you.

    Oh I don’t know Melinda, in the brief few seconds when each page loads, you do get so see some white background, which is a nice break for the eyes lol!
