    Hi there,
    Can anyone recommend an IP solicitor (anywhere in Australia) who they feels is capable of being transparent with costs of action on my behalf, doesn’t make up hours so they can charge it, and is really smart?

    Contact Jacqui Pryor – Mark My Words – she is great. one of my customers have used her and she was very impressed. She is a Member here as well.

    Thanks for the kind words Jenny :)

    “IP Solicitor” is a broad term, and I’ll be up front.. I am not a solicitor. I work in the area of trademarks and you can check out more about me/my services at http://www.mmwtrademarks.com.au. You’ll see at the site that fees are ‘flat rate’ and are quoted there…

    If you are after assistance in the area of patents then I cannot assist. You would need to engage a patent attorney for such help. I can certainly refer you to one if required.

    If you are after a trademark attorney (rather than consultant/specialist) then I can recommend either Victor NG (Markwell IP) or Kenneth Ti (Phang Legal), both of whom are members here.

    Hi Jacqui,

    Thanks for you suggestions and response.

    I probably need a IP solicitor as I have put in a Notice of Objection to the Australian Customs about a shipment, to which I was notified by my Customs and Forwarding agents, and is on it’s way here to Australia.
    The shipment of goods is coming for a company whose trademark name I have opposed and is this opposition still in process. The branding name is very similar to ours and it’s for the same product as ours.
    After my experience with another opposition with an IP solicitor and being charged a lot for a very little I decided to proceed with this opposition myself.

    I assume then that you have a trademark registration yourself to have been able to lodge the notice with customs?

    I am not quite certain from your post what your particular queries might be? Feel free to email me with any questions and I might be able to answer for you. Alternatively, I would suggest that you get in contact with either of the Trademark Attorneys referenced in my last post.

    The time off I mentioned in my last post will actually officially begin tomorrow and I will be away from my computer for at least 3-4 days before I can monitor emails again – so if your enquiries are urgent, I would suggest contacting either Kenneth or Victor – or, email me today :)

    We do a lot of IP work.

    Fixed fees for all but the litigation side.

    Opposition is pretty much litigation. We can’t do fixed fees, but we can try to be cost effective. If you aren’t in Sydney though I don’t think we can assist – it’s a policy around our office to have at least one conference with anyone we are assisting with litigation.
