I’ve been selling to the US (not intentionally, it’s just a website and some customers are naturally from the US, mostly from other countries)

I’ve been reading up and it’s become clear there is a form (W-8BEN) related to sole traders selling or gaining any income from the US. (to avoid oweing tax to US) But on the form, it says not to send to the IRS, instead send to the ‘US entity’.

Given these customers aren’t actively asking me for a form, they’re just buying the product. To whom am I supposed to be giving this form to? Or is it just if somebody from the US asked for it?

I don’t want to end up with a huge tax bill from the US given that Australians have an agreement, but if nobody is asking for the form, then it’s not clear how I make sure that is the case.

    Hi James,

When I had a website selling into the US, I was advised by my Accountant to just pay tax in Australia on my earnings.

You should see you Accountant and get some advice individual to you.

    Cheers
    Paul
