Dear all, recently a big case from the USA resolved, when U-haul and pods came to a settlement in a long-running trademark dispute.The headline “PODS wins largest corrective advertising damages ever against U-Haul, settles for $41.4 million.”
This judgement may have applications here in Australia, when an infringer advertises someones trademark and then corrective advertising is required to repair the damage caused.
It also gives another line of defence for rights owners against thieves using their IP to line their own pockets.
